By accessing and using Handwise ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

Handwise is a poker hand analysis and replay tool that uses AI to provide strategic insights. The Service allows users to:

• Upload and store poker hand histories
• Replay hands with visual representation
• Receive AI-generated analysis and recommendations
• Track hand history and statistics

3. No Professional Advice

Handwise does NOT provide professional poker coaching, gambling advice, or financial guidance.

All analysis and recommendations are:

• Generated by AI algorithms, not professional poker players or coaches
• Intended for educational and entertainment purposes only
• Not guaranteed to be accurate, complete, or optimal
• Subject to errors, biases, and limitations inherent in AI systems

You should not rely solely on Handwise for poker strategy decisions. Always conduct your own research and consult with professional poker coaches if needed.

4. Gambling Disclaimer

Handwise does not encourage, promote, or facilitate gambling.

Poker involves financial risk. You are solely responsible for:

• Your gambling decisions and their consequences
• Understanding and complying with gambling laws in your jurisdiction
• Managing your bankroll and gambling responsibly
• Seeking help if you have a gambling problem

5. User Responsibilities

You agree to:

• Provide accurate information when creating an account
• Keep your account credentials secure
• Use the Service in compliance with all applicable laws
• Not attempt to manipulate, exploit, or abuse the Service
• Not upload malicious content or engage in harmful activities
• Respect intellectual property rights

6. Data & Privacy

We collect and process your data as described in our Privacy Policy. Key points:

• Hand histories you upload are stored securely
• AI analysis is generated using your hand data
• We use Supabase for authentication and data storage
• We track key user journey events (signup, upload, hand selection, analysis requests) to improve the Service and identify user experience issues
• We may use aggregated, anonymized data to improve the Service
• You can delete your account and data at any time

7. Credits & Payment

AI analysis requires credits. By purchasing credits:

• Credits are non-refundable except as required by law
• Credits do not expire but may be subject to account closure policies
• Prices are subject to change with notice
• We use Stripe for secure payment processing

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Handwise and its operators:

• Make no warranties about accuracy, reliability, or completeness of AI analysis
• Are not liable for financial losses from using or relying on the Service
• Are not liable for technical issues, data loss, or service interruptions
• Are not responsible for third-party content or services

Your use of the Service is at your own risk. In no event shall our liability exceed the amount you paid for the Service in the past 12 months.

9. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms of Service
• Fraudulent or abusive behavior
• Extended periods of inactivity
• Any other reason at our sole discretion

You may terminate your account at any time by contacting support or using account deletion features.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email or prominent notice on the Service.

11. Age Restriction

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use Handwise. By using the Service, you confirm that you meet this age requirement.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property rights.

You agree to waive your right to a jury trial and to participate in a class action lawsuit. Arbitration will be conducted on an individual basis.

12.3 Jurisdiction and Venue

To the extent arbitration does not apply, you agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

12.4 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
